What exactly am I agreeing to? What's in the fine print?

The only thing you're committing to is that we will be the only real estate agent you're using, with an exclusive right to sale the property for as long as you desire. 

At any point before we've found you a buyer you like you can unilaterally cancel and not owe us a dime. There are no cancellation fees or any games.

My property needs a lot of work. It won't sell on market.

This is a lie that off-market buyers spread because they don’t want the competition. In fact, 40% of all on-market transactions are settled in cash, rather than with any sort of financing. In addition, 75% of all on-market transactions are “as is,” meaning the buyer can’t ask for repairs or price cuts for repairs. Fixer uppers are routine. Nothing special.

To put it another way, for every one fake buyer calling you up while you're off-market, there are 1000 real buyers cruising the Multiple Listing Service (MLS) looking for an investment.

I have to close ultra fast. I just don't have the time to wait while you market the place.

Then tell us your hard deadline and we’ll run an auction-style marketing campaign. “Highest and best offers by X date, closing on Y.” While traditional agents hate this approach, it’s a very routine process for us. And best of all, if your time frame changes later, you are under no obligation to accept any offer.

What happens if I change my mind about something? Or just no longer want to sell?

Whatever you want to happen will happen. Just let us know. You can even unilaterally cancel at any time before we have found you a buyer that you like.

What happens if I don’t like any of the offers you send me?

Then you don’t accept them. Naturally, we’ll negotiate with the buyers to try and get you what you want, but if you’re not satisfied, then you are under no obligation to accept any offer. And you don’t owe us a dime.

I had a Realtor list it once before and it didn’t go well.

Here’s your chance to get it right. Tell us what you didn’t like before and we’ll put it in the contract that we must do things your way. Unlike traditional agents, we must follow your “house rules.”

I’m already under contract with someone to sell it.

Then simply refuse to amend the contract. Make the buyer honor the terms you both agreed upon. Don’t let the off-market "buyer" renegotiate the price or get a closing date extension.

If they are really a buyer, then this should be no problem for them. If they are wholesaling instead, then they will voluntarily cancel, since they need the price to come down and/or more time to find an end buyer.
